By visiting our online store and/or purchasing a product from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the website, including without limitation, users who are browsers, customers, and/ or contributors of content.

We may modify or update our Terms of Service at any time without any prior notice. All changes will be communicated accordingly.

The website and these Terms of Service shall be governed by and construed in accordance with the laws of the State of New South Wales.

1. ACCURACY OF INFORMATION PROVIDED WHEN ORDERING

When ordering from our website, you represent that you are 18 years old or over. This will be confirmed upon your first visit of our online store.

Details that will be required by the system such as name, address, email, and contact number should be true and correct as any inaccurate information might lead to delays in processing your order or in its delivery, or even order cancellation.

2. RESPONSIBLE USE OF ALCOHOL

We would like to reiterate that the use of this website, purchasing from it, and sharing its content to others are strictly for those who are 18 years old and older only.

If you will be placing an order for yourself or for others, buyer and recipient should be both of the required age. We might require proof of identification upon delivery to validate the recipient’s age.

By ordering from our website, you acknowledge that:

  1. Domaine Wine and Spirits supports the Responsible Service of Alcohol. Under the Liquor Act 2007 - It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.   2. We may not process orders or proceed with delivery upon confirmation that the recipient is not of the required age.

3. YOUR ORDER

a. Guarantee of Wine Quality

Our stocks are regularly checked for quality and before dispatch, so you are guaranteed that you receive your order in good condition - safe, and ready for consumption.

If in case you receive a bottle which meets the following conditions, we will replace or refund:

  • If a bottle of wine is corked, oxidised or appears otherwise out of condition, provided it is still within the recommended drink date and has been stored in suitable conditions; and
  • If you suspect that the wine is not of good quality.
  • If the wine has gone past its allowed drink date upon delivery.

Replacements will be the same type of product or its equivalent value. The shipping fee will be handled by us.

The amount of refund will be the same as the amount paid by you.

b. Online Store Pricing Information and Other Charges

By ordering from our website, you agree to pay the published amount (inclusive of GST) of the product as well as its corresponding delivery fee, as determined by our site’s delivery fee calculator.

An order confirmation will only be processed upon payment.

Placing an item in your shopping cart will not be processed for delivery without payment during checkout.

Our pricing may change from time to time without notice. Always double check the product’s price before payment.

If in case a payment is made for a product that is not in stock or is no longer being offered, we will get in touch with you to ask which substitute product would you like to receive as a replacement or we can also offer you a refund.

c. Payment Methods

We accept payment through major credit cards and AfterPay. Other payment methods will be added soon.

You authorise us to charge your chosen card or payment method. If we are unable to charge or deduct, your order will not be processed.

d. Order Changes and Cancellations

Any order that has been paid for can no longer be changed or cancelled by the customer unless otherwise the following occurs:

  • System/technical errors have been identified during ordering;
  • Illegal use of the Website;
  • Fraudulent payment processing; and
  • Breach of this Terms of Service.

On the other hand, we reserve the right to accept, delay, or cancel an order under but not limited to the scenarios mentioned above.

e. Allowable Quantity Per Order

You are allowed up to 20 bottles per wine product in each order.

No minimum order is required.

We may cancel your order if we suspect bulk ordering for reselling and trading purposes. Our wine products are available from partner restaurants and bars per glass. If you are a restaurant or bar owner and is interested in offering our products within your business, please send a letter of intent to hello@domainewinesandspirits.com.au.

4. DELIVERY

  1. We deliver to most parts of Australia through our partner courier/s. If in case we are unable to deliver to your area, we will notify you immediately and determine with you our next course of action possibly, a change of delivery address, order cancellation, or refund.
  2. We do not deliver to PO Boxes, parcel lockers, and some regional or remote areas.
  3. Estimated delivery times:
    • Sydney, Brisbane, Canberra, Melbourne, Adelaide,Perth: 7-10 business days ETA
    • TAS, NT, and all other regional areas: 11-15 business days ETA
    • Our delivery fees for different locations may change without notice.
    • Please ensure to provide delivery instructions in case you will not be at the delivery address during the expected delivery or if someone else will be accepting the delivery on your behalf.
    • Tracking codes will be provided to you upon the dispatch of your order.

 5. MARKETING AND OTHER PROMOTIONS

  1. No promo can apply in conjunction with another promo.
  2. Different promos have their own mechanics and duration date so please review carefully before participating.
  3. Different discount vouchers have their own terms of use and expiration date so please review carefully before using.
  4. Discount vouchers cannot be exchanged for cash.

6. CONTENT

a. Intellectual Property
All texts, blogs, images, logo, videos, and other content materials found on our website and social media accounts are solely owned by Domaine Wines and Spirits. They are not to be copied, used, repurposed, printer, or distributed without our permission.

b. Changes to the content of the website may be applied without notice.

c. User-Generated Content
Content materials of this type include testimonials and reviews, social media posts about our products, videos made by customers about our products, and other materials made and provided by our customers are effective marketing tools for our online store. If posted on our social media accounts and other publicly-seen online accounts, these materials become shareable by us and other followers of our pages. If the materials are sent through email, we will confirm with you if you are providing us with the permission to share your material and as to how it will be shared.

Alternatively, as owners of our own website and social media accounts, we have the right to take down posts or materials shared by our customers which we find derogatory, erroneous, and false.

Our store is being hosted by Shopify but managed by us. Shopify is an online platform that provides e-commerce services for businesses like Domaine Wines and Spirits.
